Introduction:

These Terms and Conditions regulate the general conditions of use and legal information (hereinafter “T&C”) and apply to the website www.wikinight.eu (hereinafter WIKINIGHT), whose domain is www.wikinight.eu and the corresponding application mobile phone, as well as all websites related or linked to www.wikinight.eu and Wikinight, as well as its affiliates and associates (hereinafter and collectively, the “APP”). The APP is owned by Wikinight. By using the APP, the Customer agrees to these T&C. If the Customer does not agree, we ask them to refrain from using the APP or any of its features.
Through these T&C, Wikinight makes the Wikinight website, backoffice and mobile application (hereinafter collectively referred to as the Platform) available to Customers.

1. Definitions

Client

The “Client” refers to spaces, bars and clubs or other types of nightlife establishments, listed on Wikinight and in any application related to Wikinight, that use the Platform to advertise their services or introduce themselves to Users.

User

This is someone who uses the service with the intention of sharing, saving, publishing, transacting or uploading information called “managing content”). Includes other people who jointly participate in the use of the Service.

Content

“Contents” include, but are not exhaustive, images, photographs, audio, videos, location data, nearby locations, etc.

“User Content” refers to content that the User has uploaded, shared or published through the Wikinight APP, such as likes, ratings, comments, profile information and other materials displayed in their personal account.

“Wikinight Content” refers to the content that Wikinight creates and makes available in connection with the Service, including, but not limited to, features and interfaces, graphics, design, computer code, products, software, aggregated ratings, reports and other data from usage linked with your account.

“Third Party Content” refers to content available through the Service from sources other than Wikinight or its Users.

Nightlife establishments

All spaces, bars and clubs or other types of nightlife establishments, listed on Wikinight and in any application related to Wikinight.

Service

All functionalities available to the Customer, through the APP, the backoffice or the Wikinight website

Platform

The entire Wikinight APP, Website and Backoffice.

2. Object

Accesspixel, Lda. (hereinafter, just Wikinight) is a technology company, whose main activity is the development of a technological platform through a mobile or web application (hereinafter, the APP) that allows certain bars, clubs or establishments to promote their Services and offers and may, at the request of APP Users, create a direct link between the establishment and the User, which may generate points, discounts or other offers for the User to enjoy in advertised locations.

Wikinight has a platform through which different nightlife establishments – with which Wikinight may maintain a commercial agreement for the use of the Platform – offer a series of products and services. The User has the possibility of requesting the purchase of products or services through an order through the Platform and, in these cases, Wikinight acts merely as an intermediary and, therefore, does not assume any type of responsibility for the quality of the products, or the correct provision of services offered directly by Customers or by third parties.

3. Terms of Use

Access to the platform and the voluntary creation of a profile by the Customer implies knowledge and express and unequivocal acceptance of these General Conditions, the Privacy Policy and the Cookies Policy by all Customers.

4. Access and Registration for Customers

To be able to be a Customer of the Platform, it is essential that the following requirements are met:

• Be over 18 years of age;
• Truly fill in the mandatory fields of the registration form, which requests personal data such as Customer name, e-mail, telephone number and NIPC;
• Accept these Terms and Conditions;
• Accept the Privacy and Data Protection Policy ;
• Accept the Cookies Policy .

The Customer guarantees that all data provided regarding its identity and legitimacy are true, correct and complete. You are also committed to keeping your data up to date.

If the Customer communicates any false, incorrect or incomplete data, or if Wikinight considers there are well-founded reasons to doubt the veracity, accuracy and integrity thereof, Wikinight may deny access to and use, present or future, of the Platform or any of the its contents and/or Platforms.

The Customer undertakes to provide Wikinight with only truthful content, and is also obliged to keep all content inserted by it up to date.

The Customer hereby declares that it will not make or authorize unauthorized advertising.

Any promotion or offer inserted by the Customer on the Wikinight Platform is its sole and exclusive responsibility, and Wikinight is not responsible for any errors or failures in communicating such offers to the Customer's employees, at the location/night establishment.

When registering on the Platform, the Customer will select a Customer name (username) and an access password (password). Both the username and password are strictly confidential, personal and non-transferable.

The Customer undertakes not to disclose data relating to their account or make them accessible to third parties. The Customer will be solely responsible in the event of use of this data by third parties, through the use of the username and/or password.

Wikinight cannot guarantee the identity of registered Customers, therefore, it will not be responsible for the use of a registered Customer's identity by unregistered third parties. Customers are obliged to immediately communicate to Wikinight the removal, disclosure or loss of their username or password, through a Contact Form.

The Customer undertakes to maintain secrecy and confidentiality regarding any and all personal data to which it has access through the use of the Platform, being obliged to respect the Privacy and Data Protection Policy and not being able to make use of said personal data, to not be for the purposes contracted between you and Wikinight, ie, exclusively in the use of the Wikinight Platform and for promoting your services through this platform.

4.1. Profile

In order to complete registration on the Platform, the Customer must provide some data such as: company name, email address, NIPC, etc.

Once registration is completed, all Customers will be able to access their profile and complete and/or edit it as they see fit.

The way in which the Customer's personal data is treated, if any, can be found in our Privacy and Data Protection Policy .

5. Provision of the Service offered by Wikinight

The Customer acknowledges and accepts that the Service provided by Wikinight may undergo changes, and Wikinight reserves the right to suspend, cancel or terminate products and services at any time and without prior notice, as well as to make changes to any and all of its own content. , products and services contained in BackOffice or the Wikinight APP.

Wikinight reserves the right to change the tariff or establish new prices for the services provided, without any prior communication to the Customer, and may also establish that a service that was previously free becomes paid. The Customer will always be able to consult the prices established by consulting the APP or the website.

Wikinight, its software and the platform it makes available may include the option to automatically check for updates to the software, and the Customer may be notified of the existence of such updates or improvements as well as such updates or improvements to the software being automatically transferred to its device. Updates or improvements to the software may also be necessary to allow you to use the Service or part thereof (including updates to correct problems with the Platform).

The Customer accepts that, if Wikinight deactivates its account access, it will be prevented from accessing the Service, and therefore its account data, files and content.

By using the Wikinight Services, the Customer accepts that the contents of the Wikinight software exist for informational purposes only. Wikinight assumes no responsibility for any information that is not up to date. Wikinight also reserves the right to make changes to the website's content without prior notice.

Wikinight does not guarantee the prices listed on menus or the availability of all menu items at any of the establishments listed.

Unless otherwise stated, all photographs and information included in the Wikinight software are considered to be in the public domain, such as promotional materials or press files.

The Customer may send a request to remove certain materials via email geral@wikinight.eu, if they hold rights to content present on the Platform and if they consider that the use of such materials violates their Copyright. Please indicate the exact URL you are referring to in your request. No other identity will be authorized to reproduce or republish these digital versions in any format without written permission from Wikinight.

Wikinight reserves the right to charge Customers for subscription and/or membership fees, with prior notice, with respect to any product, Platform or any other aspect of Wikinight's software.

6. Use of the Service

The use of any personal information that the Customer provides to us during the account creation process is governed by the Privacy and Data Protection Policy .

The Customer must keep its password confidential and is solely responsible for maintaining the confidentiality and security of its account and all changes and updates submitted through its account, as well as all activities that occur in connection with its account.

You are responsible for all activities that occur under your account and agree to immediately notify Wikinight of any unauthorized uses to enable us to take necessary corrective action. You also undertake not to allow third parties to use your account. The Customer is solely responsible for the security and inviolability of their access data.

By creating an account, Customer agrees to receive certain communications associated with the Service, such as preferences regarding non-essential communications through account settings.

In general, Customers undertake, by way of example and without limitation, to:

• Do not alter or modify, in whole or in part, the Platform, evading, deactivating or manipulating any other of its functions or services;
• Keep the content you insert on the Platform up to date and correct;
• Do not carry out unauthorized advertising;
• Comply with the offer of all promotions that you advertise on the Wikinight Platform;
• Maintain confidentiality and secrecy regarding all content that you have access to through the Wikinight Backoffice;
• Do not violate industrial and intellectual property rights or standards regulating the protection of personal data;
• Do not use the Platform to insult, defame, intimidate, violate your own image or harass other Customers;
• Do not introduce computer viruses, defective files, or any other computer program that could cause damage or changes to the contents of Wikinight's systems or third parties;
• Do not send mass and/or repetitive e-mails to a plurality of people, nor send third-party e-mail addresses without their consent;
• Do not carry out advertising of goods or services without the prior consent of Wikinight.

Failure to comply with any of the points referred to above generates civil liability for the Customer, and Wikinight may sue for the losses caused and image damage suffered.

Any Customer may inform Wikinight of any abuse or vulnerability of these conditions, through the Contact Form.

Wikinight reserves the right to remove and/or suspend any message with illegal or offensive content, without the need for prior notice or subsequent notification.

7. Contents of the Wikinight Platform

Wikinight is the sole and exclusive owner of the Platform's copyright and exclusively holds the copyright, trademark, logos, image rights and other industrial or intellectual property rights in Portugal.

The Customer acknowledges that the Platform may contain information that is considered confidential by Wikinight and that it shall not disclose such information without the prior written consent of Wikinight, and agrees to protect the intellectual property rights of all those who have rights in the Platform during and after the termination of this agreement.

The Customer acknowledges and accepts that Wikinight owns all legal rights and interests in the Platform, including any intellectual property rights (whether or not such rights are registered, and anywhere in the world).

The Customer undertakes not to use any trademark, logo or other information owned by Wikinight; or remove, obscure, or erase any copyright or proprietary notices or font identifiers, including without limitation, the size, color, location, or style of any proprietary marks, unless prior written authorization is provided. Any infractions will lead to appropriate legal proceedings.

The Customer may not use the Platform for illegal purposes. The Customer may use the information provided by the Platform only for the purposes agreed with Wikinight, and permitted by the latter through the Customer's access to the Backoffice. The Customer accepts that it may not use, copy or modify, display or distribute, reproduce, reformat, or use in advertising materials or products, as well as commercialize in any way all or any part of the Service, Contents or Wikinight's Intellectual Property Rights, unless previously authorized in writing by Wikinight.

Any violation by the Customer may result in the immediate suspension of the right to use the Platform, as well as potential civil and criminal liabilities for infringement of copyright or other rights.

7.1. Responsibility for Content

The Customer is responsible for its Contents, guaranteeing that it is the sole author, and that it has control over all its rights or that it has been granted express authorization by the rights holder to submit such contents; that have not been copied or based on any other content, works or websites; that are truthful and accurate and that do not violate the Terms and Conditions or any applicable laws.

If the Content is an opinion, the Customer guarantees that he is the sole author thereof; that the opinion reflects a nighttime experience you had; that you have not been compensated in connection with writing and publishing the opinion and that you have not received financial, competitive or personal incentives for writing or publishing an opinion that is not a fair and honest expression of your wishes.

The Customer assumes all risks associated with its Content, including the opinion of third parties regarding its quality, accuracy and credibility, or when revealing information that makes it identifiable.

Although we reserve the right to remove content, we do not guarantee the accuracy or quality of any content published by third parties or Customers.

Without prejudice to the foregoing, Wikinight reserves the right to limit, in whole or in part, access to the Platform to certain Customers, as well as to cancel, suspend, block or eliminate certain types of content, through the use of technological instruments capable of effect, if you have actual knowledge that the activity or information stored is illegal or that it harms the property or rights of a third party. In this sense, Wikinight may establish the necessary filters in order to prevent illegal or harmful content from being disseminated on the network through the Service.

The provision by Customers of content through the Platform will imply the assignment in favor of Wikinight of all exploitation rights derived from the content provided on the Platform.

7.2. Content Removal

Wikinight reserves the right, at any time and without prior notification, to remove, block or prevent access to any content that it considers to violate the Terms and Conditions or that is harmful to the Service or to our Users and Customers, as well as as you do not consider yourself obligated to return any of Your Content.

7.3. Third-party content and links

Some of the content available through the Wikinight Platform may partially belong to third parties, and/or be linked to companies with online reservation or ordering services. The use of third-party services will be governed by their own terms and conditions, which can be obtained from contact information, and Wikinight will not take any action regarding them, nor will this guarantee their legality, degree of updating or quality. Wikinight does not screen or investigate third-party materials before or after including them on the Service.

Wikinight reserves the right to make changes or corrections to errors or omissions in any part of the content accessible through the Service, but is not responsible for any delay or inaccuracy related to such changes.

Customer acknowledges and accepts that Wikinight is not responsible for the availability of any external sites or resources, nor does it endorse advertisements, products or other materials available from such sites or sources.

The Customer further acknowledges and accepts that Wikinight is not responsible for any losses or damages that may occur as a result of the availability of such external sites and sources and the contents included therein.

Without prejudice to the foregoing, we do not assume any responsibility for offensive, defamatory or illegal content provided by third parties.

7.4. User Opinions

Wikinight is a neutral platform that only serves as a communication channel between Users and Customers.

Ads on Wikinight are published independently and have no relationship to the opinions of advertisers on the Wikinight Platform.

If the Establishment is convinced that a particular opinion is violating Wikinight Policies, it may flag it for us to consider.

Wikinight may remove a review if it violates the Terms and Conditions or is harmful to the Service.

No active or omissive behavior by Wikinight may be interpreted as approving or rejecting any association with any message posted publicly or privately through the platform.

8. Guidelines

The Customer accepts that he has read, understands and agrees with Wikinight's Privacy Policy, and that Wikinight may share his information with third parties or authorities if it is essential or relevant to identify (i) suspected illegal activities; to (ii) comply with legal proceedings or other legal processes/notices transmitted to us; (iii) enforce our Terms and Privacy Policy or (iv) protect our rights, reputation and property and those of our Customers.

9. Restriction on use

By accepting these Terms and Conditions, the Customer agrees not to publish or transmit content (including opinions) that, in Wikinight's understanding:

1) Violate our Policies;

2) Are harmful to society, are threatening, or encourage illegal activities;

3) Are a false or deliberately erroneous opinion, or that does not refer exclusively to the attributes of the Nightlife Establishment, products or services being evaluated;

4) Include content that violates the good taste of the services;

5) Violate the rights of third parties, namely the right to privacy, as well as holders of advertising, copyright or intellectual property rights, trademarks and patents;

6) Unjustifiably accuse other Customers of illegal activities;

7) Try to impersonate another person or entity;

8) Dissimulate or attempt to disguise the origin of the content they submitted, under a wrong name; or attempt to disguise the IP address from which your content was submitted;

9) Are a form of misleading advertising, or originate or result from a conflict of interest;

10) Are of a commercial nature, such as spam, contests, pyramid schemes, insertions or opinions published or removed in exchange for payment and/or at the request of the Nightlife Establishment to be evaluated;

11) Suggest that Your Content is sponsored or supported by us directly or indirectly;

12) That introduces viruses or other computer codes, files or programs that harm, destroy or limit the operability of programs, equipment or electronic communications, and that interfere with the use of the Service, servers and networks connected to the Service;

13) Hack or access confidential records of Wikinight or other Customers or Users without permission, trying to access personal information of users of the Service;

14) Attempt to determine the source code of the Service, as well as attempt to disable, damage or otherwise interfere with security features or features that impose limits on the use of the Services;

15) Violate the restrictions of any auto-delete headers on the Service, if any, or bypass or circumvent any measures employed to prevent or limit access to the Service;

16) Are published by an automatic “bot” (robot messaging system);

17) Copy, modify, sell, lease, or commercialize in any way any rights to the Wikinight Service;

You acknowledge that Wikinight has no obligation to monitor your or others' access to and use of the Service for violations of the Terms or to review or edit any content. However, we have the right to do so for the purposes of operating and improving the Service (including, fraud prevention, risk assessment, investigation and customer service), to ensure your compliance with the Terms and Conditions and to comply applicable law or a judicial notice.

The Customer undertakes not to use the service for illegal purposes and not to violate any national or international laws. You shall not post, email, transmit or otherwise make available any advertisements, promotional materials, spam, or any other form of unauthorized or unsolicited solicitation, nor shall you make any representations or warranties on behalf of Wikinight under any form.

Any Content published by the Customer is subject to the laws of the country where the use is made, and may be suspended or subject to investigation under applicable laws. Furthermore, in the event of non-compliance with laws and regulations, these Terms and Conditions or the Privacy Policy, Wikinight has the right to immediately block your access to and use of the Service and to remove any content that does not comply, as well as to take the necessary measures.

10. Customer Feedback

When you share or submit ideas, suggestions, changes or documents ("Feedback"), you agree that (i) your feedback does not include confidential, secret or private information of third parties, (ii) Wikinight has no obligations of confidentiality towards such Feedback, (iii) Wikinight may have already received similar Feedback from another Customer or may have already taken it into consideration, and (iv) by providing Feedback to us, you grant us binding, non-exclusive, royalty-free authorization, lifetime and worldwide right to use, modify, develop, publish, distribute and sublicense the Feedback,and irrevocably waives any assertions or claims of any nature whatsoever against Wikinight and its Customers in relation to such Feedback.

11. Submission of ideas

Customer agrees that: (1) Customer's idea submissions and content will automatically become the property of Wikinight, without compensation to Customer; (2) Wikinight may use or redistribute the contents in any way and for any purpose; (3) Wikinight has no obligation to review the submission and has no obligation to keep any submissions confidential.

12. Advertising

The Platform may display advertisements and promotions. These advertisements may be targeted to the type of content present on the Service, requests or questions made through the Service or other information. The form, mode and extent of advertisements on Wikinight are subject to change. In return for accessing the Service, the Customer agrees to the existence of advertising on the Service.

Part of the Wikinight APP may contain advertising information, promotional material or other material submitted by third parties. Responsibility for ensuring that material submitted for inclusion in BackOffice and the Wikinight APP complies with national and international law rests solely with the parties submitting the materials/information.

Correspondence, commercial transactions or participation in promotions of advertisers other than Wikinight found on or through BackOffice or the Wikinight APP, including payment and delivery of the goods and services to which they relate, as well as any other terms, conditions, warranties or representations associated with such transactions, is made solely between the Customer and the advertiser.

Wikinight is not responsible for any error, omission or inaccuracy in promotional material or for any loss or damage of any kind incurred as a result of such transactions or the presence of such advertisers on the Wikinight BackOffice and APP.

13. Exclusion of warranties, limitation of liability and indemnities

Guarantees

The Customer acknowledges and agrees that the Service is provided “as available” and that its use of the Service is at its own risk.

Wikinight is not responsible for any (i) errors, mistakes or inaccuracies in the content, (ii) any unauthorized access to the use of the Service, (iii) any and all information stored on the Platform, (iv) any interruption or cessation of transmission to and from the Service, (v) any Bugs, Viruses, Trojans or the like that may be transmitted to or through the Service through the actions of third parties, (vi) any errors or omissions in any content or for any losses or damages of any incurred as a result of the use of any content published, sent,transmitted or made available in any way through the Service, (vii) any material downloaded or obtained through the Service is done at the sole risk of the Customer, who will be solely responsible for any damage to his computer system or any other equipment or loss of data resulting from the download of such materials.that you will be solely responsible for any damage to your computer system or other equipment or loss of data that results from the download of such materials.that you will be solely responsible for any damage to your computer system or other equipment or loss of data that results from the download of such materials.

Wikinight will not be responsible for monitoring any transactions between the Customer and third party providers of products or services. Customer is solely responsible for interactions with Users of the Service and others with whom it communicates or interacts as a result of its use of the Service. No advice or information, whether oral or written, obtained by Customer from Wikinight or through the Service constitutes a warranty not expressly described in the Terms and Conditions.

Unless otherwise authorized in writing by Wikinight, Customer may not use any trademarks, service marks, registered names, logos of any company or organization in any manner that is likely to create confusion about the owner or Authorized Customer of such brands, names and logos.

Wikinight will not respond in the event of Service interruptions, connection errors, lack of availability or deficiencies in the Internet access Service, nor for Internet network interruptions or for any other reason beyond its control.

Wikinight is not responsible for any security errors that may occur nor for any damage that may be caused to the Customer's computer system (hardware and software), to the files or documents stored therein, as a result of:

• The presence of a virus in the Customer's computer system or mobile terminal that is used to connect to the Platform's services and contents;
• A browser malfunction;
• Use of non-updated versions of it.

Compensation

Customer agrees to hold harmless, defend and protect Wikinight from and against any third party claims, damages, actions, proceedings, demands, losses, liabilities, costs and expenses (including legal fees) incurred as a result of or in connection with: ( i) Customer Content; (ii) unauthorized use of the Services or products included in or advertised on the Services; (iii) Customer’s access and use of the Services; (iv) violation, by the Customer, of the rights of third parties; or (v) failure by the Customer to comply with these Terms and Conditions,

Wikinight maintains the exclusive right to negotiate, agree and pay, without the Customer's prior consent, all claims and legal actions brought against it. We reserve the right, at the Customer's expense, to assume the exclusive defense and control of any matters in which the Customer must compensate Wikinight.

Customer agrees not to reach agreement on any matters to which Wikinight is a party without its prior written consent.

Wikinight will use reasonable efforts to notify Customer of any such claim, action or proceeding.

14. Cancellation of access to services

The Customer may close their account at any time by contacting us via email at geral@wikinight.eu, thereby ceasing further use of the Service.

Wikinight may terminate use of the Service and deny Customer access to the Service at its sole discretion for: (i) violation of these Terms and Conditions; or (ii) lack of use of the Service.

The Customer agrees that any cancellation of their access to the Platform may be carried out without prior notification and acknowledges and agrees that Wikinight may immediately deactivate or delete their account and all related information and/or prevent access to their account or Service. Furthermore, you agree that Wikinight shall not be liable to you or any third party for the suspension or termination of your access to the Service.

15. General terms

Full contract

The Terms and Conditions, together with the Privacy and Data Protection Policy, constitute the entire agreement between the Customer and Wikinight with respect to the Services.

The failure or delay on our part to exercise any rights, powers or privileges under the T&C does not constitute a waiver of such rights or the acceptance of any variation in the Terms and Conditions, nor the exercise by either party of any rights, powers or privileges excludes the future exercise of any other right, power or privilege.

Use of the Contract

If any provision of these Terms and Conditions is for any reason considered null, invalid or voidable by a judicial body, such provision must be removed from these Terms and Conditions, and the remainder of the Terms and Conditions must maintain full validity and legal effect.

Applicable law, expiry and prescription

The Customer must initiate any legal action within a maximum period of (1) year after the alleged damage began.

Failure to exercise rights within this period excludes any claims or causes of action regarding the same facts or occurrences, notwithstanding any expiry periods or other laws to the contrary.

Within this period, the failure to enforce or exercise any provisions of these terms or any related rights shall not constitute a waiver of exercise of the right.

Connections and framing

You may link to the Service on the basis that you acknowledge and agree that you will not link the Service to any website that contains inappropriate, profane, defamatory, infringing, obscene, indecent or illegal topics, names, materials or information, or that violates intellectual property. , property rights, privacy or publicity rights. Any violations of this provision may result in the termination of your use and access to the Service with immediate effect, and Wikinight may use the legal means at its disposal to hold the violator of this rule liable.

16. Copyright Infringement Notice and Grievance Resolution Mechanism

Wikinight shall not be liable for any Infringement of intellectual property rights relating to materials published or transmitted through the Backoffice or the Wikinight APP, or items advertised on the Wikinight APP, by End Customers or third parties.

We respect the intellectual property rights of others and expect everyone who uses the Service to do the same.

We may, in appropriate circumstances and at our sole discretion, remove or prevent access to materials on the Service that infringe the copyright rights of others.

We may also remove or disable links or references to online locations containing infringing materials or activity.

In the case of Customers who repeatedly disregard the copyright rights of others, we may unilaterally terminate that Customer's right to the Service.

If you believe that your copyright is being infringed by content found on the Service, you should follow the steps below to file a notification:

a) Identify in writing the protected material that you believe is being disrespected;

b) Identify in writing the material on the Service that you claim is infringing, and provide sufficient information to identify the location of the alleged infringing material (for example, the username of the alleged infringer and the name of the establishment at which it is located). published);

c) Include the following statement; "I have a good faith belief that use of the content on the Service as set forth above is not authorized by the copyright owner, its agent, or the law.";

17. Geolocation

Wikinight may collect and use approximate location data via IP address. This location data may be collected and used by Wikinight to improve the way we deliver our content.

18. Applicable Legislation

The relationship between WIKINIGHT and the Customer will be governed and interpreted in accordance with the Terms and Conditions, which in terms of interpretation, validity and execution, will operate in accordance with Portuguese legislation; and any dispute will be submitted to the Courts of Lisbon, unless the Customer requests the courts of his/her place of residence.

19. Extrajudicial dispute resolution

In accordance with the provisions of article 14 of Regulation (EU) No. 524/2013, Wikinight informs that the European Commission has established an online extrajudicial dispute resolution platform to resolve disputes relating to contractual obligations arising from purchase/sale contracts or for the provision of Services concluded online between a consumer resident in the Union and a trader established in the Union. Therefore, the Customer can access this Platform through the following link: http://ec.europa.eu/consumers/odr/ .
